Lemon Law

Charleston, West Virginia, Lemon Law Attorneys

West Virginia's lemon law is designed to protect consumers from defective cars and trucks. There are various rights and options available to consumers under the lemon law. However, car dealerships and manufacturers may not always comply with the law. At Hunt & Lees, L.C., we provide representation to people under our state's lemon law.

If you believe you have a defective car or defective truck that meets the lemon law requirements, contact a lawyer from our firm to learn how we can help.

What are the lemon law requirements?

To qualify under West Virginia's lemon laws, the vehicle must have a defect that substantially impairs the vehicle's use or value. The owner of the vehicle must have taken the vehicle in for repairs during the warranty period. It is required to give the dealer a reasonable number of attempts to repair the vehicle defects. For most situations, three attempts to repair a vehicle in a thirty day period is considered to be a reasonable number of attempts.

What are my options?

Our firm provides comprehensive help to consumers throughout the process of resolving the defect claim. We will accompany our client to the manufacturer's inspection and have an expert do an independent report on the vehicle. Consumers have three options available:

  • Buy back program - The dealer or manufacturer can purchase the defective vehicle and reimburse the claimant for car payments and attorney's fees.
  • Dealer can provide consumer with a new car
  • The consumer can file suit under the state's lemon laws - This often forces the manufacturer to finally deal with the vehicle's defect.

As a consumer, you have rights. At Hunt & Lees, we can help you stand up for your rights and get you into a safe car. Contact us today to arrange your consultation.
